Genuine Emiratisation: What Counts, and the Rules on Fake Roles

Emiratisation counts real roles with real duties, and almost every employer delivers exactly that. To protect genuine careers, the rules set out penalties for roles that are not genuine, on three tracks: per worker for fictitious employment, per establishment for circumventing targets (AED 100,000, rising to AED 300,000 and AED 500,000 for repeat offences), and criminally in serious cases, with any Nafis support repaid.
Genuine roles are the heart of Emiratisation
Emiratisation works because Emiratis build real careers in real roles. Almost every employer does this properly, and the rules exist to protect that: for Emirati professionals, for the companies investing in them, and for the national programme.
Why the published numbers differ
Search for the fake Emiratisation penalty and you will find AED 20,000, AED 100,000, AED 500,000 and AED 1 million. They describe different penalties for different things.
| What it covers | Instrument | Range |
|---|---|---|
| Beneficiary does not start work after the permit, where support was received | Cabinet Decision No. 43 of 2025 | AED 20,000 per worker, plus a ministry fine of up to AED 100,000 per case and suspension of support |
| Circumventing targets, per establishment | Cabinet Resolution No. 44 of 2023 | AED 100,000, rising to AED 300,000 and AED 500,000 for repeat offences |
| Criminal cases, including fictitious Emiratisation | Federal Decree-Law No. 33 of 2021, as amended by Federal Decree-Law No. 9 of 2024 | AED 100,000 to AED 1,000,000, multiplied by the number of workers involved |
The three categories in plain terms
Fictitious employment is registering a UAE national who is not genuinely working. Cabinet Decision No. 43 of 2025 lists several violations, each with its own penalty. The AED 20,000 per worker figure is for one specific case: the beneficiary never starts work after the permit is issued and support has been received. Do not read it as the fine for every form of fake Emiratisation.
Circumvention is structural: artificially reducing headcount to fall below a threshold, reclassifying roles to shrink the skilled denominator, or otherwise arranging the establishment to avoid an obligation. Penalties are per establishment.
Criminal cases sit above both. The labour law, as amended, sets a fine of AED 100,000 to AED 1,000,000 for fictitious recruitment, including fictitious Emiratisation, multiplied by the number of workers, and requires government benefits received to be repaid. The administrative and criminal tracks are separate; they do not automatically stack in every case.
How MoHRE monitors compliance
MoHRE says its inspection systems, including AI tools, flag fake Emiratisation and attempts to get around targets, and that it acts against violators by lowering their establishment classification and applying corrective measures. It encourages anyone to report violations through its call centre on 600590000, website or app.
What genuine employment looks like
For an employer doing this properly, the evidence is the ordinary trail of someone doing a real job:
- A MoHRE-registered contract describing the role accurately.
- Salary paid through WPS, matching the contract and at least AED 6,000.
- Pension registration with GPSSA.
- Normal records of work: attendance or system access, work product, correspondence, appraisals.
Almost every company is doing this properly. The simple habit that helps most is keeping good records of the real work Emirati colleagues do, from day one.
Frequently asked questions
01What is fake Emiratisation?
Registering a UAE national in a role that is not genuine, to meet a target or claim Nafis support, or arranging an establishment to get around its obligations.
02What is the penalty for fake Emiratisation?
It depends on the violation. Where a beneficiary never starts work after the permit, AED 20,000 per worker plus a ministry fine of up to AED 100,000 per case; per establishment for circumvention, AED 100,000, rising to AED 300,000 and AED 500,000 for repeat offences; and in criminal cases, AED 100,000 to AED 1,000,000 multiplied by the number of workers. Nafis support must be repaid.
03Is missing a target the same as fake Emiratisation?
No. Missing a target triggers the monthly contribution. Fake Emiratisation is a separate violation with its own penalties.
